摘 要

近年来，我国信托行业得到了迅速的发展，并且随着《关于进一步加强房地产信贷业务管理的通知》的颁布，其促进了国家对房地产行业发展的的控制，因此房地产信托成为了金融业的一个新亮点，它灵活的特点和独有的优势强有力的推动了房地产的发展。房地产信托由金融信托业与房地产业结合而产生，它为投资者拓宽理想的房地产投资渠道增加他们的流动资金的同时减少了经济贸易风险。对于开发商而言，房地产信托的产生无疑是为房地产行业对的发展提供了一条重要的融资渠道。至2006年底，房地产的信托融资总量已上升为500亿左右。目前我国的房地产信托主要针对于贷款方面，但这并不能够改变以融资为主体的局面。

本文在宏观经济调控的大背景下，采用实证分析、比较、定量分析、理论与现实相联系等方法，对房地产的信托的发展进行研究。首先对研究背景、研究意义、实际应用价值进行描述，其次介绍房地产信托的基本理论、含义和功能。随后分析房地产信托业的发展历程、运作模式以及在我国的可行性。紧接着分析他们可能面临的一些问题和风险以及这些问题产生的原因，和他们的运作是在一个什么样的法律、税收金融环境下进行的。对比分析国外REITS，借鉴他们的经验和教训。最终提出解决问题的措施，为促进房地产信托业的健康发展提出了科学的建议。

Regulating the Period after the Development of Real Estate Trust Business Patterns and Trends

ABSTRACT

In recent years, the national trust industry has a high speed of development. Under the promulgation of the law, named on the further strengthening of the operational management of real estate credit business, which promoting the control over the development of the real estate industry for our country. Hence, the real estate trust becomes a new bright spot in the financial industry. The real estate trusts consists of the features of financial trust industry and real estate industry, which offering opportunities for development and various financing choices, each with advent ages and disadvantage. For developers, the generation of real estate trusts is undoubtedly provides an important financing channels for the development of the real estate. By the end of 2006, the real estate trust financing amount has increased to about 50 billion. At present, our country real estate trust is mainly for loans, but this does not change the situation, which has the main body of financing.

Under the background of macroeconomic regulation and control, this paper proposed empirical analysis, comparison, quantitative analysis, theory and reality to study the development of trust in real estate. Firstly, the research background, research significance and application value were given; then we introduced the basic theory of real estate trust, meaning and functions. Then we analyzed the real estate trust development courses, operation mode, and analyzes the feasibility in our country. Next, we analyzed that they may faced some problems, risks and the causes of these problems, and their operation under different kinds of laws and financial tax environment. Comparative analysis of foreign REITS, learning from their experiences and lessons. Under the known of the methods solving the problems, we proposed the scientific recommendations to develop our of the real estate trust.

随着中国经济的迅猛发展，房地产业在金融贸易中的作用越来越不可忽视。房地产业的快速前进推动了有关房地产的信托业的进步，在国家的宏观调控下，由于有关房地产的信托融资通过审批的时间较短，信托产品灵活性强，能够满足投资商的资金供给需求，因此房地产信托对于他们而言就像是一根救命的稻草。作为一种新的融资方式，它为我国的信托行业带来了很大的机遇和挑战。2008年，关于房地产的信托融资开始掀起一顿热潮，据调查，2008年7月，关于资金的信托产品的投资规模已经达到了36.34亿，其中与房地产有关的达到了17.35亿。发行的关于房地产的信托产品有65个，其中贷款类品种29个，股权类有15个，权益类有10个，其他4个。2010年下半年，住房价格的持续上升带来了一定的波动，政府为了稳定房价，陆续的出台各种调整政策^[1]。从2009—2013期间，房地产信托模式从0.14万亿上涨到了1.13万亿。本文通过分析关于房地产的信托在发展历程中的一些状况，发现存在问题并借鉴国外的经验提出合理的解决方案，为房地产信托开辟新道路^[2]。

1.1.2 研究意义

房地产投资信托的市场的运作的经验也越来越丰富，市场空间日益扩大，作为金融工具的他在房地产金融体系中有着不可小觑的作用。依据我国的房地产业的发展状况和金融市场的需求，借鉴国外的经验，提出解决的方法，为房地产信托业寻求出路。本文的研究意义如下：
