摘 要

农业为我国经济建设和发展提供所需的基础产品，是立国之本，在2015年的“两会”中党提出了2020年我国全面进入小康的目标。然而许多地区的农村距离这一目标仍有着较大的差距，因此在接下来的几年中，发展农村经济，对加快小康社会的步伐显得特别重要。农村土地由于青壮年外出前往城市家中没有劳动力或其他情况导致了许农村出现大量土地闲置的现象，因此传统意义的土地管理机制显然很难适应新形势下产业农民在土地资源流转市场的倾向性需求。这种情况下，浙江绍兴借鉴了信托制度将其应用到土地流转中率先实行了农村土地信托流转机制，并以这一大胆举动取得实际效果之后，引起了各方面的广泛重视，一些地区也开始对土地资源市场信托流转机制实施进一步摸索和创新。伴随着农村地区整个土地资源流转市场初步成型，在价格上实现了稳定递增，不少产业农户积极参与，保留承包权，转让使用权。这一制度在土地公有制的基础上，满足了农民之前对土地流转的要求，在提高了土地的使用质量的同时，增加了农民收入，推动了农村经济的发展。

本文站在支持农村土地信托流转机制运行的立场上，针对现行农村的土地流转制度，旨在有效提高农村土地利用效率、节约相关资源、推动农村经济发展。在说明农村土地现状之后，展开对信托制度和土地信托制度的介绍：农户通过中介人将承包地的经营权转让出去，在保留承包权的时候仍旧拥有土地提供的保障。接着分析我国农村土地信托流转机制的可行性与必然性，随后将之前的理论分析与后面提出浙江绍兴与安徽宿州两个列子进行结合论证，在两个列子之间也进行对比分析，反映了农村土地信托流转机制的政府模式和金融模式两者相互可取之处与不足。然后阐述农村土地信托流转机制现存的几点不足：法律制度不完善、起步阶段面临较大风险、发展后劲不足缺少支持。随后针对现状与存在的问题，尝试性的从单位个体和国家社会两个方面提出相关意见。

In 2015, we put forward the goal of entering the well-off society in 2020. However, there is still a big gap between rural areas in many areas, so it is very important to develop the rural economy in the next few years to accelerate the pace of the well-off society. Now rural land due to the young migrant to city home without labor or other circumstances led to many rural appear the phenomenon of a large number of idle land, so land management mechanism of traditional obviously difficult adaptation under the new situation of the industry, farmers in the market of land resources tilt to the demand. In this case, Shaoxing is a town in the Zhejiang Province ,it from the trust system will be applied to the land circulation has taken the lead in implementing the trust of rural land transfer mechanism, and to this bold move to obtain actual effect, caused the wide attention in all aspects, some areas also began to land resources market, trust transfer mechanism further Mo said. With the rural area of the whole land resources transfer market, the initial shape, the price to achieve a stable and increasing, a lot of industry farmers to participate actively, to retain the right to contract, the transfer of the right to use. On the basis of public ownership of land, the system can meet the requirements of farmers before the land transfer, in improving the quality of the use of land, increase the income of farmers, and promote the development of rural economy.

The station in position to support the operation of the rural land trust mechanism, in view of the current rural land circulation system to effectively improve the rural land use efficiency, saving resources, promote the development of rural economy. After the description of the current situation of rural land, launched on the trust system and the land trust system: farmers through intermediaries will be contracted to the right to transfer out of the contract, in the right to retain the contract is still owned. Followed by an analysis of feasibility and necessity of the trust mechanism of the circulation of rural land, then base on theoretical analysis and the back is proposed in Shaoxing, Zhejiang Province and Anhui Suzhou ,two examples is the combination of argumentation,A comparative analysis of two examples , reaction of the rural land trust bypass mechanism model and the government financial model both mutually desirable and deficiencies. Then elaborated the rural land trust circulation system now some problems: the legal system is not perfect, the initial stage faces a big risk, lack of support for the development of stamina.Then, according to the current situation and existing problems, this paper puts forward some suggestions from two aspects, which are individual and national society.
