摘 要

近几年，我国林产品对外贸易发展迅速，贸易规模不断扩大，加之国内外市场对林产品的需求激增，林产品贸易在国际市场上扮演着越来越重要的角色。但“两头在外”的贸易模式在国际生态环保发展需求的背景下遭遇瓶颈，林产品贸易争端与纠纷频频发生。在此背景下研究和剖析与我国相关的林产品国际贸易争端的典型案例有利于总结经验教训，以应对案件诉讼和进一步发展我国林产品贸易。

本文总结了近十几年间全球和我国林产品争端发展状况；从内部和外部两个角度简要探析了争端发生的主要原因；同时，通过对案件起因、案件发展过程、案件终裁的简述，分析了两起美对华林产品反倾销的典型案例，并经过两起案件的对比分析，引发思考，总结经验。研究提出了提升我国企业核心竞争力、完善应诉机制、深化国际合作的相关应对策略。本文旨在帮助企业树立积极应诉态度以期提高应诉胜率；为政府提供减少摩擦的策略和建议。

Case Analysis on China’s Forestry Products International Trade Disputes and Revelations

ABSTRACT

In recent years, China's forest products trade has developed rapidly, as well as the trade scale, combined with domestic and international market demand for forest products, forest products trade plays a more and more important role in the international market. However, the "two out" trade mode has encountered the bottleneck under the background of international ecological and environmental protection development demand, and the trade disputes between forest products have frequently occurred. In this context, it is helpful to study and analyze the typical cases of international trade disputes related to China's forest products in order to sum up the experience, so as to deal with case litigation and further develop the trade of forest products in China.

This paper summarizes the development status of forest products disputes between China and the world in recent decades. The main causes of the dispute are briefly analyzed from both internal and external perspectives. What’s more, through the causes of the cases, development process of the cases, a brief of the cases’ consequences, we analyzed two typical forest products cases of anti-dumping in China, and through comparing and analyzing two cases caused by thinking, sum up experience. The research puts forward relevant coping strategies for improving the core competitiveness of Chinese enterprises, improving the responding mechanism and deepening international cooperation. The purpose of this paper is to help enterprises to establish a positive response attitude in order to improve the winning rate. The proposal to avoid friction for the government and the forestry industry is also provided.
